- Leading Languages provides it’s services to you (the user) at www.leading-languages.com and through it’s related services subject to the following terms. We reserve the right to change these terms and will notify users by email and by posting the changes on this page and through our social media platforms.
1.1 The Leading Languages website helps students and parents find tutors and classes.
2. “User”, “you”, “your” means an organisation, group, body, parent, student or tutor using these services.
2.1 “campers” means any student that is or has taken one of our online camps.
2.2 “camps” means a group of consecutive lessons with a tutor and campers.
2.3 “tutor” means the designated adult teacher teaching the virtual classes and / or camps.
2.4 “parents” means the designated or person responsible for students or “campers” below the age of 18 years.
2.5 “students” means any child or adult that is receiving an educational class or camp with Leading Languages.
2.6 “classes” means online, virtual classes made available for sale on this site.
3. Description of Services
3.1 Leading Languages is an educational provider, an online marketplace and a publisher. A user can register on the website as a student or tutor.
3.2 For: Educational provision
3.3 Leading Languages provides academy trusts, schools and nurseries with extra curricular classes in return for payment. These classes are created and written by Leading Languages in accordance to the individual agreements, agreed by Leading Languages and the other party. These classes do not partake the subject of ‘online marketplace.’ Leading Languages will only work with organisations and trusts that can evidence correct and regular safeguarding checks are completed as per our safeguarding policy.
3.4 For: Online Marketplace
3.5 For classes and camps provided on our online marketplace, Leading Languages does not create, own, sell, resell, control these classes and camps. The role of Leading Languages in this function is to act as an agent between the parent or student and the tutor. In this capacity Leading Languages accepts payments from a parent or student on behalf of the tutor. Leading Languages vets all tutors and allows tutors to access our services after these checks have been completed however students and parents are responsible for checking the credentials, expertise, references, qualifications and insurance polices of any tutor with whom they confirm a booking.
3.6 For: Publisher
3.7 Leading Languages is an Independent publisher. Published works in various medias are owned by Leading Languages.
4. User responsibilities – this applies to both tutors, students and campers and anyone else that uses our services
4.1 All users are responsible for their own security both online and offline.
4.2 Users must not use the website with the intention of engaging directly with other users outside of the website, classroom, message services or other such services that are managed and represented by Leading Languages.
4.3 Users must not promote other services or opportunities of any other company other than Leading Languages on our website.
4.4 Users are responsible for their own content that they post on the website.
4.5 Users must report any defamatory, illegal or offensive material that they view on the website.
4.6 Users must exercise their own judgement regarding the accuracy of information provided on the website. Leading Languages cannot and does not guarantee that all of the content on the website is complete or up to date.
4.7 Users must notify Leading Languages Immediately if they feel their account or password has been compromised.
4.9 Users are responsible for checking their bookings and attending these booked lessons, camps on time.
4.10 Any users that in Leading Languages opinon fails to meet these terms will be removed from access to our services.
4.11 All fees must be made payable to Leading Languages to confirm a booking, class or camp. All bookings must be made online via the website: Leading Languages or the linked booking systems. All payments must be made via our online booking system or by electronic invoice.
4.12 Incorrectly purchasing using discounts to which you are not permitted or knowingly providing false information to us or the schools/establishments we work with could result in Leading Languages stopping the supply of services, courses, lessons or sessions to the user.
4.13 No remission of fees will be given for absence, except when due to long illness – over four continuous weeks – and supported by a doctor’s note, or at teacher’s discretion.
4.14 Should you decide to withdraw your child from classes held in a school and the school charge Leading Languages a room rental fee, Leading Languages will require half a school term’s, paid, written notice. If the school does not charge us, no notice period will be required. Please note, the notice period starts from the day that Leading Languages is informed in writing via email on: email@example.com
4.15 Should you decide to withdraw your child from our classes held in our community settings*, (excluding schools) no notice period is required.
4.16 For the purpose of comprehension, a school is not classed as a community setting in our terms and conditions. It is a separate and different category meaning that the terms applied to what is referred to as a ‘community setting’ is not a school setting.
4.17 The tutor reserves the right to mute a students microphone or put them in a virtual waiting room thus removing them from the class if he/she has not maintained satisfactory standards of conduct or whose presence in the class is held to be disruptive and undesirable and the teacher will notify you should this problem arise. Removal of your child will only take place as a last resort after all other avenues of help & support have been given.
4.18 The tutor is only responsible for children within the classroom during scheduled class hours, and it is your responsibility to ensure that your child or user attends and leaves at the designated hours.
4.19 Should your child suffer from a medical condition requiring special care please inform the tutor in writing at the enrolment stage.
4.20 In community and school classes, Leading Languages may introduce food into the classes to widen the cultural learning of the said language being learnt. Please state on the booking form online whether your child suffers from any food or drink allergies, e.g. nuts, milk, etc., giving full details and if you do or do not give your permission for this.
4.21 For in school and community classes the tutor may wish to take group photos and/or have media coverage when holding special events, giving certificates or to promote the services or products of Leading Languages. This may be in the form of photos, promotional video clips or other media forms. These photos could be in the press or on the facebook page or the internet such as on our website, www.clubonyva.com or www.leading-languages.com other promotional websites such as you tube. Children will not be named in these photos. We require your permission before your child’s photo may be taken. Please indicate if you do not agree to this.
4.22 All online lessons and camps that take place on Leading Languages video chat are automatically recorded. Lessons can be stored for a period of up to two years. These recordings can be made available to the tutor for 1) users that have missed classes. 2) For quality control. 3) Educational purposes. Leading Languages may also use these recordings for 1) quality control 2) To improve our services 3) Compliance purposes 4) Customer support
4.23 Leading Languages can decide to delete these recordings if: 1) A parent requests them on the basis of personal identifiable information 2) To protect users if policies or terms have been violated. Recordings and images of users will not be used for any other purposes without your written consent. By using the online marketplace services of Leading Languages you fully understand and accept that users will appear in class recordings as outlined above.
4.24 In community and school classes, Leading Languages operates a signing out register which you are required to sign after each class when collecting your child to ensure that correct safeguarding measures are operated. Please ensure you sign for your child when you collect them.
4.25 In school lessons can be postponed or cancelled pending a sufficient attendance, at the teachers discretion.
4.26 If we receive any communications that we consider to be consistently rude, abusive, offensive, discriminative, inappropriate or malicious or defamatory from a user we reserve the right to stop supplying our services to the said person, parent or child and we may consider taking the appropriate legal action where required. This means that your place as a user may be terminated with immediate effect and no refund for any remaining classes will be given.
4.27 You are soley responsible for all video, images, emails, information, data, music, software, code, graphics messages and any other resources or media that you have used to provide your lessons, camps and courses through Leading Languages.
4.28 The following behaviours are prohibited by Leading Languages and we reserve the right to investigate, report and take appropriate legal action against anyone who in our opinion violates this provision:
Is intoxicated, abusive, rude offensive, violent, defamatory, pornographic, harassing, libellous, racist or discriminative whilst using, promoting, presenting our services.
Infringes our intellectual property or the property of other third parties.
Uses any of the Leading Languages trademarks and logos without our written consent.
Is involved in or creates processes to harvest or collect email addresses and any other personal information from users.
Solicits personal information from any users.
Interferes with or disrupts our servers, websites, social media accounts or other.
Violates any national or International law.
Advertises or sells illegal products or services or engages in criminal activity.
Impersonates any person or entity.
4.29 You acknowledge that Leading Languages is protected by copyright and trade mark, trade secret law and as such features, services and content used by Leading Languages shall not be used by yourself, modified, reverse engineered, sell sublicense or other. As such yuo shall not sell distribute, sell, modify, copy, frame, scrape, rent, or create derivative works based on the service, the service content or the trademarks or trademarked products and services represented by Leading Languages.
5. Tutor Obligations
5.1 Tutors are required to be knowledgable in the classes that they are teaching.
5.2 Tutors must regularly check their bookings and messages from users and respond in a timely manner.
5.3 Tutors must be professional and respectful to users at all times.
5.4 Tutors are solely responsible for the preparation of their classes ensuring thus that all resources, devices and equipment are fully fit for purpose.
5.5 Tutors must abide by all terms as set forth above, including those tagged where relevant as ‘users’.
5.6 Tutors are responsible for their own taxes and licenses.
5.7 If a parent or student purchases your classes, camps or courses you agree that you shall provide them as contracted to by this purchase.
5.8 Leading Languages is not an insurer, agent or employer for tutors.
5.9 You agree that Leading Languages shall collect payment for classes, camps and courses on your behalf from the student and / or user.
6.0 As a tutor you are responsible for your own behaviour and conduct whilst using and accessing our services.
6.1 Tutors request to deregister from our services must inform us in writing and we will remove their profile from our website within 28 days of being informed.
7.0 Payment terms
7.1 Users, Parents, students and campers agree to pay for services as set out on the website in the currency specified at the time of sale.
7.2 If a parent or student disputes payment they must do this within 30 days of purchase.
7.3 Tutors will be paid via paypal after their classes have completed by paypal within an appropriate time frame. In order to receive payment tutors must have an active paypal account with the same email address which they have registered as a user with Leading Languages.
7.4 If it is reported that by parents or students over the age of 18 years that a tutor had not completed a class or camp or were not adequately provided we reserve the right to not transfer to the tutor payment for that class or camp. Should this be the case, we will investigate and may decide to issue a refund to the parent or student. All decisions made by Leading Languages in such cases are binding.
7.5 These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with English law and the courts of England shall have exclusive jurisdiction to settle any such dispute or claim will be decided only by the courts of England.
8.0 Limitation of Liability
8.1 LEADING LANGUAGES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES. LEADING LANGUAGES SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LEADING LANGUAGES SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND OUR REASONABLE CONTROL.
8.2 THE LIMITATIONS AND DISCLAIMER IN THIS SECTION DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
